EU Court to Review WhatsApp Appeal

The Court of Justice of the European Union (CJEU) has decided to refer WhatsApp's appeal against the European data protection supervisory authority back to the General Court, prolonging a legal dispute linked to a €225 million fine imposed on the company.
The CJEU ruled that the appeal by WhatsApp Ireland against the binding decision 1/2021 of the European Data Protection Board (EDPB) is admissible, overturning a previous ruling by the General Court.
The case concerns the EDPB's intervention in a dispute between national authorities, resulting in the Irish data protection authority increasing corrective measures against WhatsApp, including the €225 million fine for violating the GDPR.
The case returns to the General Court for a substantive review regarding WhatsApp's potential violation of the GDPR.
