Errors in Rebate Guidelines for Medical Technology

The Ministry of Health has issued guidelines for the implementation of the rebate on medical technology products, but typographical errors have been identified. The circular states a discount rate of 7% instead of the 5% stipulated in the ministerial decision. In addition, the publication date of the JMD is incorrectly stated as 2024, while the actual date is March 11, 2025.
According to the circular, the mandatory discount scales up to 5% and concerns medical technology products and reagents, excluding medical equipment. The discount is imposed on public contracts for medical technology supplies from all contracting authorities in the health sector.
The rebate is effective from March 11, 2025. The rebate is calculated based on the turnover per supplier and per hospital in the previous quarter. Coefficients of 0%, 3%, and 5% are provided depending on the turnover.
The discount is paid after the end of each quarter by the supplier. The possibility of offsetting the discount amounts with equal debts to the supplier is provided. In case of non-compliance, compulsory collection is provided through the Public Revenue Collection Code.
Maintenance services and medical technology equipment are excluded.
