New Rental Regulation: Eviction Without Court from 2026

Changes in the way landlords can reclaim their properties when a lease expires are coming into effect on January 1, 2026. Under the new regulation, landlords will be able to issue an "Order for Eviction" through a lawyer, avoiding lengthy court proceedings.
The regulation, included in Article 72 of the new law on the Code of Civil Procedure, aims to restore a "long-standing injustice" against landlords, according to POMIDA. At the same time, it provides protection for tenants, granting at least 6 months' notice before eviction.
Key points of the new procedure:
- The landlord sends an extrajudicial notice 3 months before the contract expires.
- If the property is not returned, an "Eviction Order" is requested from a lawyer, without going to court.
- The tenant can file an objection and request an extension for a valid reason.
- Enforcement takes place 2 months after notification, giving a total deadline of at least 6 months.
