Kitiou Case: Guide for the Investigation Against Phaidon

Lawyer Simos Angelides analyzed the legal prerequisites for the arrest of a mayor, referring to developments surrounding the mayor of Paphos and the case of the deceased Metropolitan of Kitiou.
Mr. Angelides emphasized that the passage of time does not invalidate the need for arrest if there is a risk of interference in the investigation, influencing witnesses, or altering evidence.
The Kitiou case is used as a legal reference point, as it shows that the passage of time does not prevent the prosecution of serious crimes. Despite allegations against the Mayor of Paphos for incidents 12 years ago, the precedent of the Metropolitan's conviction confirms that such cases are not time-barred.
Mr. Angelides recalled the amendment to Article 113 of the Municipalities Law in 2022, which allows for the suspension of elected officials. If activated, it will be the first time it has been applied in Cyprus to a mayor. During the suspension, the elected official is removed from duties with 1/3 of their salary and returns only in case of acquittal.
