POMIDA: Changes to Lease Termination – 15 Q&As

The Panhellenic Federation of Property Owners (POMIDA) welcomes the new framework for recovering properties after lease termination, publishing 15 questions and answers regarding the changes.

POMIDA emphasizes the determination of the Ministry of Justice to redress a "blatant historical injustice" towards owners, through Article 72 of the new law on the Code of Civil Procedure. The regulation aims to relieve the courts of simple cases, ensure the timely return of properties to owners, and encourage the release of closed properties to the market.

POMIDA answers 15 questions about the new regulation, clarifying that it does not allow owners to "throw tenants on the street" in 1-2 months, but provides safeguards for tenants.

Among other things, POMIDA explains the procedure for issuing an "Eviction Order," the deadlines that apply to owners and tenants, and the possibilities tenants have to protect their rights.

From 1.1.2026, eviction orders will be issued by specially certified lawyers, while a three-month notice period to the tenant and a two-month execution period after service are provided.

POMIDA emphasizes that the new regulation does not allow early termination of a housing lease due to owner-occupation or sale, as the contractual term and the legal three-year period remain inviolable.
