The situation regarding the New Building Regulation (ΝΟΚ) is expected to become clearer from September, with the Council of State's (ΣτΕ) opinion on the draft Presidential Decree.

The ΣτΕ will examine the issue of the start of construction works. Those who started work by December 11, 2024, can use the benefits of the ΝΟΚ.

Those who did not make it will have to revise the building permit without the incentives of the ΝΟΚ, removing elements such as lofts, attics and swimming pools that were deemed unconstitutional.

According to the Ministry of Environment and Energy (ΥΠΕΝ), the right to build is not lost, only in the part concerning the incentives (1 to 2.5 meters). No additional taxes will be paid for the revisions.

There are two categories of professionals: those who use the bonuses and those who renegotiated without them. An environmental balance will be paid by license holders with pending court cases.

Engineers report that the issuance of a building permit no longer secures the owner's right to build.

The ΝΟΚ as legislated in 2012 is no longer valid. Municipal appeals to the ΣτΕ regarding the ΝΟΚ are a reason to change the planning for urban planning.

The environmental balance will include a fee and interventions to upgrade the area. The start of work is considered excavation, ΕΦΚΑ stamps, archeological and demolition works, and any work related to the permit and proven by a public document.
